What is the settlement statement, or the seller’s closing and settlement statement?  Here’s what real estate investors need to know.

Here’s what real estate investors need to know about the settlement statement.

This is another document that is going to maybe come into play with other closing documents, such as the selling disclosure.  It really depends on where you live, but if you come across it as an investor then it is important to know what you’re reading.

The Settlement Statement is also called the Seller’s Closing Statement.

This document is the breakdown of the seller’s net profits.  This is prepared by an attorney, title company or escrow company.

The first 11 sections are as follows.

1.File/Escrow number 9.Settlement/Closing date

2.Date & Time 10.Disbursement date

3.Officer/Escrow Officer 11.State required dates

4.Settlement location

5.Property address

6.Buyer

7.Seller

8.Lender

9.Settlement/Closing date

10.Disbursement date

11.State required dates

In the debts/credits section, it’s broken down like this

1.Property sale price

2.Personal property

3.Earnest money

4.Loan amount

5.Existing loan amount

6.Seller credit

7.Excess deposit

Loan charges section:

1.Points

2.Application Fees

3.Origination Fees

4.Underwriting Fee

5.Flood Tax monitoring fee

6.Flood monitoring Fee

7.Prepaid interest

8.Appraisal Fee

9.Credit report Fees

10.Flood determination Fee

11.Mortgage Insurance premium

12. Tax Status Research Fee

The next two sections:

‘Impounds section’

This portion that allows the buyer to lump expenses together with a breakdown.

For example:

Homeowners insurance @ $X/month

‘Title Charges and Escrow/ Settlement Charges’

Title insurance, title search fee, title company closing fees, notary fees, signing fees, etc.

The Last Sections:

‘Commission’

How much the seller’s agent, buyer’s agent and others are getting paid.

‘Government Recording and Transfer’

This includes deed recording fees, transfer taxes and other related fees to the recording of the closing documents as the transition happens.

‘Payoffs’

This is the seller loan payoff info as well as interest payoffs and any seller loan fees.

The last two sections:

‘Miscellaneous’

This may be home inspection fees, HOA dues, home warranty fees, etc.

‘Subtotal’

Now you have the configured sum of all the columns.  The dollars due to seller.  These came about after the subprime crisis of 2008 when regulations were put in place to make all real estate transactions more transparent to all parties involved.

While you may not yet see these in every closing, if you do it’s important to make sure you understand what’s going to be laid out before you.

Different states have different rules about using these documents at closing, so that will be a determining factor as well.  So that is something to keep in mind for investors as well.  

So that is a detailed walkthrough of the seller’s closing statement and/or the settlement statement.  As an investor you should know this for yourself and for your clients so that you can walk them through all the details.
